Case History and Orders
Our work against American Family Insurance Company began when we were approached by lawyers who were interested in having Beth Klein design a successful class action against American Family for enhanced PIP or no-fault benefits. Numerous attempts had been made to certify a class action of this nature, but all previous attempts had failed.

The action was filed because from July 1, 1992 to January 29, 2001, American Family uniformly and systematically failed to underwrite Complying Extended PIP Policies and failed to make offers of Extended PIP Benefits as mandated by C.R.S. 10-4-710 and Colorado case law. The Class Action was designed so that all applicable policies would be enhanced and that American Family would have to comply with the law.
American Family tried to have the case dismissed based upon the fact that other cases had failed to get class certification. This firm prepared extensive briefing, and on October 7, 2004, Judge Sandstead rule in our favor.
