Colorado Wrongful Death Law Laws permitting wrongful death claims were enacted in the 19th century to permit recovery of damages for death caused by the wrongful act of another. These laws, otherwise known as statutes, were created by legislatures rather than through the common law which is case law developed through the court system. Because the Colorado wrongful death laws originated through laws enacted by the legislature (statutes) Colorado courts have not expanded any rights under these laws. Ty, Inc. the manufacturer of Beanie Babies has refused to comply with a request from the State of Illinois to recall the Jammin Jenna doll. What do you need to know about Cough Medicine and Kids?

Beth Klein

Beth Klein

In 1997, pediatrician Ian Paul, learned from the American Academy of Pediatrics that two popular over-the-counter cough suppressants, codeine and dextromethorphan, did nothing to relieve coughs in young children and that there was scant research on the efficacy of these medications. Dr. Paul decided to conduct tests on Benadryl and dextromethorphan himself on kids aged two to 18. The results showed that the drugs were no better than a placebo at relieving symptoms and that they did not aid sleep. Ten years later, the Centers for Disease Control reported that 1,519 children under two were brought to emergency rooms in...

Insurance Company Corporate Policies to Deny Valid Claims

Beth Klein

Beth Klein

In every case that we try, the reason we are going to trial is because the insurance company has made adecision to process the claim in the deny, delay, devalue fashion. In every case that we try juries express that they believe that "there are too many lawsuits." However, in Colorado that has some of the strictest tort reform in the Court, that is not the case. In Washington when faced with a law designed to make insurance companies treat people fairly, big insurance is fighting hard witha referendum and advertising campaign of misinformation. The FDA is evaluating important safety information about gadolinium-containing contrast agents and a disease known as Nephrogenic Systemic Fibrosis or Nephrogenic Fibrosing Dermopathy (NSF/NFD) that occurs in patients with kidney failure. New reports have identified a possible link between NSF/NFD and exposure to gadolinium containing contrast agents used at high doses for a procedure called Magnetic Resonance Angiography (MRA). An MRA test uses magnetic resonance imaging to take pictures of blood vessels. During an MRA test, a drug known as a gadolinium-contrast agent is injected into a patients vein so blood vessels can be distinguished from other nearby tissues. The FDA...
